The New York City Taxi and Limousine Commission (TLC) wishes to inform its licensees about two new marking requirements for TLC licensed vehicles. All TLC licensed vehicles (except for black cars and luxury limousines) will now be required to include a Driver Protection sticker in the passenger compartment. Please see below graphic for specific placement. This sticker requirement is pursuant to Local Law 55 of 2014, otherwise known as the Driver Protection Act. All TLC licensed vehicles must be in compliance with this requirement by September 30, 2015.

All Official Taxicab Vehicles (OTVs), also known as the Taxi of Tomorrow and other TLC licensed vehicles with Hearing Induction Loop capability will now be required to include Hearing Induction Loop Decals. Please see below graphic for specific placement. All OTVs and other TLC licensed vehicles with Hearing Induction Loop capability must be in compliance with this new requirement by September 30, 2015.


 

 


INDUSTRY NOTICE #15-26

UPDATE: TLC DRIVER’S LICENSE REQUIREMENTS TO OPERATE STREET HAIL LIVERIES (BORO TAXIS)

The New York City Taxi and Limousine Commission (TLC) is extending the grace period for Street Hail Livery (SHL) drivers to fulfill the below requirements to operate SHL vehicles and Accessible SHL Vehicles through January 4, 2016. The original extension for the grace period was due to end on July 1, 2015.

The TLC would like to remind all its licensees that in order to operate an SHL vehicle, drivers must have one of the following pursuant to TLC Rule §54-04.1:

  • A valid Taxicab Driver’s License, OR

  • A For-Hire Vehicle (FHV) Driver’s License issued on or before July 1, 2013, OR

  • A Paratransit Driver’s License (for Accessible SHLs only).


To operate an Accessible SHL vehicle, drivers must have one of the following pursuant to TLC Rule §54-04(n):

  • An FHV Driver’s License issued on or before July 1, 2013 and completion of the wheelchair assistance training course, OR

  • A valid Taxicab Driver’s License and completion of the wheelchair assistance training course, OR

  • A Paratransit Driver’s License.


During the grace period, drivers with FHV Driver’s Licenses issued after July 1, 2013 can continue to drive SHL vehicles and no summons will be issued. Likewise, drivers of Accessible SHL vehicles can continue to operate during the grace period without completing an approved training course on wheelchair passenger assistance.

However, starting on January 5, 2016, the LPEP system will lock out all ineligible drivers and they will be unable to operate an SHL without the appropriate licensure and/or training.

TLC TECHNOLOGY OFFERS AN EASIER WAY TO SUBMIT TRIP RECORDS & GET A RECEIPT

New Affidavit System Avoids the Need for a Notary

The New York City Taxi and Limousine Commission (TLC) would like to remind base operators that the following trip record submission deadlines are approaching:

Due June 30, 2015

Wave 1 and 2 bases: May 2015 trip records

Wave 3 bases: April and May 2015 trip records


Due July 31, 2015

Wave 1, 2 and 3 bases: June 2015 trip records


Due August 31, 2015

Wave 1, 2 and 3 bases: July 2015 trip records


Please note that monthly submissions will continue to be required in this manner until the TLC notifies you that weekly submissions are required. If you do not know what Wave your base is in, please visit www.nyc.gov/triprecords and find the “List of Wave Assignments.”

In addition, beginning with the June 30 submission, all bases will be required to electronically sign an affidavit stating that they have either:

1. Submitted a true and accurate trip record report; or

2. That the base didn’t dispatch any trips during the reporting period.


To make trip record submissions as easy as possible for you
, the TLC has created a new “Files Drop” service that is specifically customized for each base. It will make submitting your records as simple as “1, 2, 3” and will even provide an email receipt of your submission when you are done.

The TLC has also made the Trip Sheet Affidavit process far easier by enabling bases to use Electronic Affidavits and Electronic Signatures.

TLC PUBLISHES LIST OF MEDALLIONS SELECTED DURING JUNE 25, 2015 ACCESSIBILITY DRAWING

The New York City Taxi and Limousine Commission (TLC) wishes to inform its licensees that it has published the list of independent unrestricted medallions that were selected during the accessibility drawing on June 25, 2015.

The selected medallions, each of which has a scheduled vehicle retirement date in 2016, will be required to place an approved accessible vehicle into service when their current vehicle is retired (first retirement cycle). The medallions not selected in the drawing are not required to place an accessible vehicle into service when their current vehicle is retired. However, each medallion’s accessibility requirement will alternate during each subsequent retirement cycle. For example, those medallions not selected in this drawing will be required to hack up an approved accessible vehicle in the next (subsequent) retirement cycle.

All owners whose medallions were entered into the drawing will receive a letter from the TLC detailing the results of the drawing and next steps. Please see below for the complete list of selected medallions.

UPCOMING CHANGE TO THE CURRENT LICENSEE LISTS ON OPENDATA

The New York City Taxi and Limousine Commission (TLC) would like to notify its licensees that the lists of current medallions and SHL permits located on the New York City OpenData Mine ("Medallion Vehicles - Active" and "Street Hail Livery Permits") will be updated to include the Expiration Date. This expiration date is needed for logging into the Licensing, Application, Renewals and Summonses (LARS) system when making a Taxi or SHL Improvement Fund payment.

On both lists the column entitled "Type" previously said either "Med" or "Street Hail Livery" respectively. That column will now be titled "Expiration Date" and will contain the expiration date for the Medallion License or Street Hail Livery Permit in question. This change will take place effective July 13, 2015.

TLC ANNOUNCES OFFICIAL TAXICAB VEHICLE RULES EFFECTIVE 9/1/15

The New York City Taxi and Limousine Commission (TLC) wishes to inform all Medallion and Taxicab vehicle owners that the Official Taxicab Vehicle Rules will take effect September 1, 2015.

For Taxicab vehicles placed into service on or after September 1, 2015, the following requirements apply:

  • Unrestricted Medallions may only be hacked-up with a Nissan NV200 also known as the Taxi of Tomorrow, an alternative fuel taxicab vehicle approved for use by the TLC, or an accessible Nissan NV200;

  • Alternative Fuel Medallions may only be hacked-up with an alternative fuel taxicab vehicle approved for use by the TLC; and

  • Accessible Medallions may only be hacked-up with an accessible taxicab vehicle approved for use by the TLC.


Please note: Owners wishing to hack-up a vehicle that does not comply with the Official Taxicab Vehicle Rules must receive a vehicle certification letter from TLC’s Licensing Unit no later than 8/31/15.

NEW YORK – On June 18, 2015, Attorney General Eric T. Schneiderman announced that his office and the New York State Department of Financial Services have agreed to the terms of a consent order and judgment with Lyft, a company that provides for-hire livery services where the company, among other things, dispatches cars through a phone app.

The consent order, which resolves an action filed against Lyft in July 2014, requires Lyft to pay $300,000 in penalties for alleged violations of New York state and municipal laws , one of the largest penalties enacted against a ‘sharing economy’ company to date. Lyft has agreed that it will comply with the relevant provisions of the New York Insurance Law.

“I have always been committed to fostering an innovative and competitive environment in which both new and existing companies can flourish in our great state,” Attorney General Schneiderman said. “However, it’s critical that the laws put in place to protect consumers and ensure fair competition are not violated in the process.

Today’s agreement enables Lyft to grow and prosper within the bounds of state and local regulations, while the penalties imposed send the message that companies that attempt to skirt the law will be held accountable.

I want to thank former Superintendent Lawsky and the Department of Financial Services for their continued partnership in making New York’s marketplace one where all entrepreneurs can thrive under the same set of rules.”
