N.Y. STATE SENATE PASSES AIRPORT ANTI-HUSTLING LEGISLATION

STATE OF NEW YORK

IN ASSEMBLY • June 4, 2007

AN ACT to amend the vehicle and traffic law, in relation to unlawful solicitation of ground transportation services at an airport THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

EXPLANATION--Matter in ITALICS (underscored) is new; Matter in brackets { } is old law to be omitted.


Section 1. Subdivision 4 of section 1220-b of the vehicle and traffic law, as added by chapter 313 of the laws of 1994, is amended to read as follows:

4. Any person who engages in the unlawful solicitation of ground transportation services at an airport shall {for a first conviction thereof} be punished by a fine of not less than {one hundred} TWO HUNDRED FIFTY dollars nor more than {two hundred fifty} ONE THOUSAND dollars, or by imprisonment of not more than fifteen days or by both such fine and imprisonment; {for a second conviction thereof, both of which were committed within a period of twelve months, such person shall be punished by a fine of not less than two hundred fifty dollars nor more than one thousand dollars, or by imprisonment of not more than thirty days or by both such fine and imprisonment; upon a third or subsequent conviction thereof, all of which were committed within a period of eighteen months, such person shall be guilty of a misdemeanor punishable by a fine of not less than seven hundred fifty dollars, nor more than one thousand five hundred dollars, or by imprisonment of not more than forty-five days, or by both such fine and imprisonment}.

Notwithstanding any contrary provision of law, any charge alleging a violation of this section shall be returnable before a court having jurisdiction over misdemeanors.

S 2. This act shall take effect immediately.

On page 11 of the July issue of TLC Magazine in a special industry brokerage announcement the Deputy Commissioner for Public Affairs of the New York City Taxi Limousine Commission was referred to as the assistant Chairman of the Commission. This was an error. He is the Deputy Commissioner for Public Affairs.


NEW FUEL EFFICIENCY RULES GO INTO EFFECT OCTOBER 1, 2008

ALL NEW TAXICAB VEHICLES BROUGHT INTO SERVICE MUST ACHIEVE A CITY RATING OF 25 MPG

In accordance with Rule 3-03(c) of the New York City Taxi and Limousine Commission, beginning on October 1, 2008, all taxicabs hacked up must meet a minimum city rating of 25 miles per gallon( mpg) or be wheelchair accessible pursuant to TLC Rule 3-03.2. In order to assist medallion owners in complying with this requirement the TLC has developed a new program with auto manufacturers and local dealerships to ensure supply of higher mileage vehicles for the taxi industry.

With increased fuel costs the demand for vehicles that meet or exceed 25 miles per gallon is expected to rise. As with most other vehicle models, dealers generally require that vehicle orders be placed well in advance of needed date of delivery. The TLC has been working with local dealerships and major auto makers to ensure availability of TLC-approved vehicles. It is important that all owners of retiring taxicabs plan accordingly to meet the new standards starting October 1, 2008.

Below is a list of approved vehicles that qualify for the new 25 mpg standards. While all vehicles are available for normal retail purchase automotive manufactures have committed to provide over 300 vehicles per month to local participating dealers for vehicles ordered four months in advance of delivery. Vehicles committed are:

• 50 Chevrolet Malibu Hybrids,

• 50 Ford Escape Hybrids, and

• 200 Nissan Altima Hybrids.


Below is a current list of approved vehicles:

1. 2009 Chevrolet Malibu Hybrid

2. 2008, 2009 Ford Escape Hybrid

3. 2008, 2009 Honda Civic Hybrid

4. 2008, 2009 Lexus RX400H Hybrid

5. 2008, 2009 Nissan Altima Hybrid

6. 2008, 2009 Saturn Vue Hybrid

7. 2008, 2009 Toyota Prius Hybrid

8. 2008, 2009 Toyota Camry Hybrid

9. 2008, 2009 Toyota Highlander Hybrid
