TLC HEARINGS BY PHONE OPTION NOW AVAILABLE

1. Complaining witnesses now have the option to testify by telephone

The NYC Taxi and Limousine Commission is implementing a new policy in its courts. Complaining witnesses (complainants) can now choose to testify by telephone instead of going to court. A witness is a person who makes a complaint about a TLC licensee and participates in a TLC court hearing.

Beginning December 8, 2008, complaining witnesses can decide if they want to participate by telephone or in person.


2. Licensees now have the option to testify at their hearings by telephone (telephone hearings in Staten Island office ONLY)

Licensees (respondents) will have the choice to be able to testify by telephone at TLC's Staten Island facility (1893 Richmond Terrace), instead of going to a hearing in Long Island City (32-02 Queens Boulevard) or Manhattan (40 Rector Street). This is a pilot program to see how well this system works.

Beginning December 22, 2008, licensees can decide if they want to participate by telephone or in person. In order to participate by phone, licensees will need to sign a form that states they will not use mistaken identity as a defense. Respondents will still be able to claim they did not commit the offense(s) in question.


UPDATE:
VEHICLE REPLACEMENT EXTENSION FOR CERTAIN MEDALLION TAXICABS

December 19, 2008

The New York City Taxi and Limousine Commission (TLC) today announced that the owners of medallion taxicabs that are still in service, but were scheduled for replacement from October 1, 2008, to January 19, 2009, may remain in service until January 20, 2009. A previous extension allowed vehicles an extension on vehicle replacement until December 19, 2008.

Vehicles that were scheduled for replacement from October 1 to December 19, 2008, must be presented at the TLC's Woodside Safety & Emissions facility for an initial Safety & Emissions vehicle inspection between December 19, 2008 and December 31, 2008 between the hours of 10 a.m. and 5:30 p.m. If the vehicle passes inspection, it will receive an inspection sticker valid through January 31, 2009.

Vehicles that are scheduled for replacement from December 20, 2008, to January 19, 2009, must be presented at the TLC's Woodside Safety & Emissions facility for their regularly scheduled Safety & Emissions vehicle inspection. If the vehicle passes inspection, it will receive an inspection sticker valid through January 31, 2009.

TLC DEFERS BLACK CAR MPG REQUIREMENT REGULATION FOR A PERIOD OF ONE YEAR

INDUSTRY NOTICE # 08-20

The New York City Taxi and Limousine Commission (TLC) today announced that due to the impact of the economic downturn on Black Car industry revenues as well as its subsequent negative effect on Black Car vehicle financing, the implementation and enforcement of regulations requiring that all Black Cars being placed into service as of January 1, 2009 achieve a city rating of 25 miles per gallon will be deferred for a period of one year. As stated above, the enforcement of provisions set forth in Section 6-09(a) of TLC For-Hire Vehicle Rules ( Black Car Specifications; effective June 22, 2008) will be deferred for a period of one year modifying the compliance date from January 1, 2009 to January 1, 2010. Regulations implementing the mandatory retirement of vehicles used as Black Cars has also been deferred.
